I found the old "shoot first and ask questions later" thread that Anarchist did.
In the beginning he mentioned a new law in Texas that gives a homeowner the right to defend his property with force without fear of repercussion.
It's called the "Castle Doctrine" and it's active in a few states.
We had to go in depth about it in my concealed carry class.
We don't have it in Virginia and my instuctor wanted to make sure
we knew that.
But here's what this thread is about:
The moral capacity of such a law. Plain and simple.
The ability to use deadly force against someone who might not be directly threatening your life.
Regardless of how bad I want it in Va., and even if it has saved many
homeowners from theft of their property or bodily harm,
it has caused the death of quite a few unintentional trespassers.
One of them might one day be you or someone you love,
or the law could save your family's life.
What do you guys think?

i like it, it exists in florida too.

and here you don't even really have to be in any danger, its more or less if someone is illegally in your house you can kill them

now it would be a shame if someone drunk or fucked up on a variety of other substances happened to stumble into someone's house by mistake and get killed..... but still, the good outweights the bad

its better that guilty men don't go free. imagine that the guy was a killer. he would kill you. dead. so then we'd still have innocent deaths. if u have the right to protect yourself then the killer will be taken care of, and he wouldn't be able to kill anyone ever again. but if you cant do anything to him, then he can just kill you and will be able to do whatever he wants to anyone else.

You wanna know the shitty part?
In Virginia you really can't do anything unless the guy is directly threatening your life or someone else's. Seriously. And, apparently, even if that's the case, if you have an escape route, you HAVE to take it.
If a guy's breaking into your backdoor and you see he has a gun, but you have the ability to run out the front door, and you shoot and kill him, you can catch a murder rap. No shit.
Kinda gay, huh?
Or say, you come home and a guy's stealing your TV, but he doesn't produce a weapon or threaten you in any way, all you can do is call the cops.
But the way I see it, it would be my word against a dead guy's,
and no one could be sure what he said. :)

exactly.......plus, maybe he got a hold of your gun and a struggle ensued......
perhaps he may have grabbed a knife, many things could happen and it wouldn't take much to make them look like they did if you fucked up

probably wouldn't get murder, more like voluntary manslaughter or something less
plus if your lwayer is good enough you can make any situation look life threatening and the use of deadly force completely nessesary

in canada it is horrible for that basically the same as Virginia, if some guy is in my house with a gun i am not worried about the law fuck that i want to survive

The castle doctrine law exists in Oklahoma and Georiga aswell. Although in Oklahoma most people call it the make my day law. Although I think (i could very easily be wrong) their are several stipulations that make it a little different than the other ones. For instance lets say that someone was trying to break into my house by kicking the door down. I would have to verably warn him several times (and have a person testifying in court) that I didn't warn the person before I shot him through the door. Also if he does make it into my house and see that I have a gun and runs. I can't follow him out of the house and kill him while he's running away cause then thats considered manslaughter.

then again, like many countries our country was formed by ordinary citizens (the militia) killing people (the limeys [haha fun word]). that and our almost limitless and only mildly restricted guns that are everywhere.

thats prolly why we have such a big volunteer army, we like cappin bitches

true but ur dead either way....with manslaughter that could be life which is death in a sense...not being able to live ur life how u want to...on the other hand after wastin a guy u could run and kill whoever got in ur way....but on the other hand u can just get shot in the first place and take the shooter with you....but on the other hand runnin would be better cuz then u could kill who ever since ur already a murderer...

i think it's a pretty good idea, but before passing it land/home owners should take extra precautions (if thats the right word).
What i mean is that they should make sure that every couple yard or so, the fence should have a sign saying "no trespassing" or "private property". this could easily prevent "accidental" shootings in someone's property.
